Eighteen hours of apologies and a charge that was upgraded to manslaughter with possible malice . The two doctors accused in the case of the death of Giorgos Mazonakis are expected to cross the doors of Korydallos prison tomorrow.
Specifically, on Thursday morning, Ioanna Gaka and Elias Theodoropoulos are expected to be transferred from Evelpidon to the penitentiary, following a relevant order from the judicial authorities. According to information, the prison sentences were issued today at noon. The two defendants had been deemed remanded in custody after their marathon pleas, which were completed at dawn.
The indictment, as finally formulated, concerns intentional homicide with possible malice committed by omission , after the upgrade from fatal exposure. This is a change of decisive importance, as possible malice presupposes that the perpetrator foresaw the possibility of death and accepted it, a gravity completely different from that of negligence.
According to information, the investigator and prosecutor attribute to the two defendants acts and omissions associated with the loss of human life, assessing their behavior as particularly critical after the singer’s health deteriorated.
The rationale for the pretrial detention refers to the fact that the two doctors performed serious medical procedures in a place without the required license , without the appropriate equipment and without having previously subjected the patient to the necessary examinations .
The delay in calling the emergency services was also assessed as particularly aggravating. The defendants allegedly failed to call an ambulance in time, without providing sufficient justification, at a time when they themselves were unable to provide the necessary medical assistance to revive the patient from cardiac arrest.
A critical point is also their reaction to the alarms of the plasmapheresis machine . Despite the indications that, according to the reasoning, signaled a serious deterioration in the patient’s condition, the medical procedure allegedly continued inside their office on Karneadou Street.
The judicial authorities, according to the same information, conclude that the two defendants were fully aware of the consequences of their actions and omissions. They also consider that no other procedural measure is sufficient to prevent the risk of committing new criminal acts, except for temporary detention. The reasoning also refers to actions that, in the opinion of the authorities, hindered the investigation of the case by concealing information.
The defense, however, is preparing a counterattack. The two defendants announced that they will appeal against the pretrial detention order, in an attempt to have it annulled. The development was announced in an official statement by the founder of the law firm representing them, Nikos Agapinos , who is criticizing the procedural management of the case.
“Following the expected development in relation to the procedural treatment of our clients, Elias Theodoropoulos and Ioanna Gaka, as a result of the completely unjustified upgrade of the charge, we will immediately appeal the temporary detention order to the competent Council, as we believe that their procedural rights have been brutally abused,” the statement states.
The case therefore enters a new phase. The Council of Misdemeanor Courts is called upon to decide whether the temporary detention will be maintained, while the two doctors retain the presumption of innocence until an irrevocable court decision is issued.
